Hotel or Vacation Rental in Hawaii in 2026

For most stays of a week or less, a hotel or a vacation club resort is the better choice in Hawaii in 2026 and 2027, and for a group of four or more staying seven nights or longer, a legal vacation rental usually wins on price. That is the short answer to airbnb vs hotel in Hawaii, and the rest of this guide shows the working. The key word is legal. Every county now restricts where short stays can operate, Oahu most recently in 2022. Maui passed a law in December 2025 that will end short-term rentals in thousands of condos from 2029, Honolulu fines illegal operators up to $10,000 a day, and the Big Island’s registration requirement arrived on 1 September 2026. Choosing hotel or vacation rental in Hawaii is now a rules question first and a price question second, and this guide answers both, with the county rules by island, a worked cost comparison at three, seven and fourteen nights, and the cancellation protections that differ more than the price does.

Last updated 6 September 2026. County rules, court cases and platform policies below were checked between 4 and 6 September 2026 against county planning department pages, court filings as reported, and the platforms’ own policy pages. Rules change with each council session, so check the county page linked in the table before you pay a deposit. This is general information, not legal advice.

The short version

  • Short-term rentals are legal in Hawaii only in the zones each county allows. On Oahu that means the resort districts, mainly Waikiki, Ko Olina and Turtle Bay, plus a few mapped apartment pockets. On Kauai it means the Visitor Destination Areas at Poipu, Princeville, the Wailua to Kapaa coast and Nawiliwili. On the Big Island it means resort, hotel and certain commercial and multifamily districts plus registered older rentals. On Maui it still means most resort condos, for now.
  • Maui’s Ordinance 5909 ends short-term rental use in roughly 7,000 apartment-zoned condos on 1 January 2029 in West Maui and 1 January 2031 elsewhere. Those condos are legal to book in 2026 and 2027. Lawsuits are pending and no injunction had been reported as of late August 2026.
  • Both pay the same 18.7 percent lodging tax. A rental with no tax line is a warning sign, not a bargain.
  • At the same headline rate, a hotel is cheaper for three nights, the two tie at seven, and a rental is cheaper by two weeks, because the rental’s cleaning fee is fixed and the hotel’s resort fee is nightly. A family that needs two hotel rooms tips the answer to a two-bedroom condo at any length.
  • A hotel with a flexible rate can be cancelled a day or two before arrival. A rental’s cancellation terms are set by the host, and if the listing turns out to be illegal, the platform refunds you but does not pay the difference to rebook.

Hawaii vacation rental rules in 2026, island by island

Airbnb is legal in Hawaii only in the zones each county allows. Oahu treats any stay under 30 consecutive days as transient. Maui and Kauai use 180 days. On the Big Island the zoning rule turns on stays of 30 days or less, while the newer registration law reaches any rental of 180 days or fewer. Anything transient needs the right zoning or a grandfathered certificate, and the state confirmed the counties’ power to phase such rentals out in Act 17 of 2024. The rules below are what a visitor needs. The county pages have the maps.

IslandWhere a short stay is legalThe rule and its status in September 2026What to check
OahuResort districts, mainly Waikiki, Ko Olina and Turtle Bay, a few mapped apartment pockets, and grandfathered homes with a nonconforming use certificate. The city’s terms are transient vacation unit and bed and breakfast home.Ordinance 22-7 (2022) as amended by 24-14, 25-2 and 25-52. A federal court blocked the city’s 90-day minimum in October 2022, so the enforced minimum outside those areas is 30 days. Fines of up to $10,000, and up to $10,000 for each day a violation continues.Every legal unit has a city registration or certificate number. Check it on the Department of Planning and Permitting’s eligibility and compliance maps.
MauiCondos in hotel districts or hotel-designated resort parcels, permitted short-term rental homes and bed and breakfast homes (permits are capped by area and largely exhausted), and, until the phase-out dates, apartment-zoned “Minatoya list” condos.Ordinance 5909 (Bill 9), passed 15 December 2025 and signed by Mayor Bissen. Apartment-zoned rentals end 1 January 2029 in West Maui and 1 January 2031 elsewhere. See the Maui section below.A condo is legal because of its building’s zoning, not a per-unit number. Check the building against the county’s apartment-district list on its short-term rentals page. Homes and B&Bs carry a permit number.
Big IslandThe V resort district, hotel districts, the CG and CV commercial districts, and RM multifamily districts inside a General Plan resort node, plus older rentals elsewhere with a nonconforming use certificate. The county’s zoning term is short-term vacation rental.Ordinance 2018-114 sets the zoning. Ordinance 25-50 requires every transient rental of 180 days or fewer to register, $250 for hosted and $500 for unhosted rentals under the county’s fee schedule, with registration open from 1 September 2026. The council was finalising a bill in early September to treat 1 September to 31 December 2026 as the registration window with violation fees waived. Fines for unregistered operation run up to $10,000.Every legal rental should hold a county TVR registration number from the Planning Department’s registration portal, or a certificate number for an older rental outside the permitted districts.
KauaiThe Visitor Destination Areas, which cover Poipu, Princeville, the Wailua to Kapaa coast and Kalapaki and Nawiliwili, grandfathered rentals elsewhere with a nonconforming use certificate, and permitted homestays where the owner lives on site.Kauai County Code Chapter 8, Article 17 (Ordinance 864 as amended). Rentals of 180 days or less are prohibited outside the Visitor Destination Area and no new certificates are issued. Existing certificates renew annually with no grace period.A location inside a Visitor Destination Area, or a certificate number on the county’s list of nonconforming rentals by parcel, updated 26 August 2026.

The practical effect is that a whole-home rental in a residential neighborhood for a week is illegal on every island unless it holds a grandfathered certificate, and those are rare and shrinking. Legal short stays cluster in the same resort areas where the hotels are. A condo in Kaanapali, Wailea, Poipu, Princeville, Waikoloa or Ko Olina is usually fine in 2026 and 2027, and on Maui after that it depends on the building’s zoning. A house in Kailua, Haiku, Kapaa town or Holualoa usually is not, however good the reviews.

The Maui vacation rental ban affects 2029 trips, not 2026 or 2027 ones

Maui’s law gets the headlines, so here is what it does and does not do. Ordinance 5909 removes the right to rent for under 180 days from condos in the apartment districts, roughly 7,000 listed units in buildings mostly built before 1989 that had operated as vacation rentals under a 2001 county legal opinion by Richard Minatoya, codified by the council in 2014. West Maui units, in Lahaina, Kaanapali, Honokowai, Kahana and Kapalua, lose that right on 1 January 2029. Units elsewhere, mostly in Kihei and Wailea, lose it on 1 January 2031. Condos in hotel districts or hotel-designated resort parcels, permitted short-term rental homes and bed and breakfast homes are not affected.

Kihei and Wailea are the trap, because apartment-zoned and hotel-zoned complexes sit side by side and the brand on the door does not tell you which is which. Neither does a management company. Aston, Outrigger and Castle all run rental programs inside apartment-zoned buildings on Maui as well as in hotel-zoned ones. The county’s apartment-district list settles it, and it is the one thing to check before booking a Maui condo for 2028 or later.

Nothing changes for a visitor booking 2026 or 2027. A Minatoya-list condo is legal to rent today. What changes is the risk profile. Owners facing a 2029 deadline may sell, convert to long-term rental or stop maintaining a unit, and a booking for 2028 or 2029 in an apartment-zoned building carries a real chance of cancellation as the date approaches. Book a hotel-zoned resort condo in Kaanapali or Wailea, or a hotel, and you carry none of that risk. At least two owner lawsuits filed in December 2025 argue the law is an unconstitutional taking. No injunction had been reported as of late August 2026 and the deadlines stand. Our 2026 tourist rules roundup tracks the status.

Both pay the same 18.7 percent tax and legal listings show it

Hawaii charges the same lodging taxes on a rental as on a hotel. The 11 percent state transient accommodations tax, the 3 percent county tax and the general excise tax passed on at 4.712 percent add up to 18.712 percent on the room rate and on any mandatory fee, which means resort fees and cleaning fees are both taxed. Hawaii has no arrangement for Airbnb or Vrbo to collect these taxes, so a legitimate host registers with the state and adds the tax as a line on your booking. State law requires the host’s transient accommodations tax registration number to appear in the listing, and legitimate hosts show the general excise number alongside it. Our guide to Hawaii hotel taxes shows a worked bill for both.

Airbnb vs hotel in Hawaii at three, seven and fourteen nights

The fair way to compare is to hold the headline rate equal and add what each side actually charges. A full-service hotel adds a resort fee, typically $45 to $60 a night, and parking, free at many neighbor island resorts and $23 to $69 a night in Waikiki. A rental adds a one-time cleaning fee, typically $150 to $350 for a Hawaii condo, and the platform’s guest service fee, which on Airbnb runs 14.1 to 16.5 percent of the subtotal. The table uses a $300 nightly rate for both, a $50 resort fee, $30 hotel parking, a $250 cleaning fee, a 14.1 percent service fee and free rental parking, with the 18.712 percent tax on lodging and fees and the 4.712 percent excise tax on separately billed parking. It compares one hotel room with a one-bedroom condo. Most Hawaii hotel rooms sleep four, so a family of five needs two rooms, a suite or a condo, and the last row prices that case for nine nights with a two-bedroom condo at $450.

StayHotel totalHotel per nightRental totalRental per nightCheaper
3 nights, one room or one-bedroom condo$1,341$447$1,528$509Hotel by $187
7 nights, one room or one-bedroom condo$3,128$447$3,121$446Even
14 nights, one room or one-bedroom condo$6,257$447$5,910$422Rental by $347
9 nights, family of five, two rooms or two-bedroom condo$7,762$862$5,711$635Rental by $2,051

The shape of that table is the point. The hotel’s cost per night never moves because its extras are nightly. The rental’s cost per night falls every night because the cleaning fee is spread thinner. At equal headline rates the break-even is about a week. A rental only beats a hotel on a short stay when its headline rate is well below the hotel’s, and at a 15 percent discount the three-night totals are still level. For a group that needs two hotel rooms the answer flips, because a two-bedroom condo costs less than two rooms at any length, and a kitchen saves a family $50 to $100 a day on breakfasts and lunches that the table does not count.

Two things make hotels cheaper than the table shows. Seventeen Hawaii hotels, at our September 2026 count, charge no resort fee at all, listed in our guide to Hawaii hotels with no resort fee, and Hilton waives the fee on full points stays and Hyatt on points stays. One thing makes rentals more expensive than the table shows. Many condo listings now add a nightly amenity or damage-waiver fee on top of cleaning, which our resort fees guide covers.

Cancellation and protection differ more than the price

A hotel booked on a flexible rate can be cancelled without penalty until 24 to 72 hours before arrival, and Hawaii hotels have generally waived penalties during declared emergencies such as the 2023 Maui fires, though that is a case-by-case decision, not a right. The cost of that flexibility is a rate 10 to 15 percent above the prepaid one. A rental’s cancellation terms are set by the host from the platform’s menu. Airbnb’s strict option refunds half if you cancel seven or more days before check-in and nothing after that, apart from a 48-hour grace period after booking. Our guide to cancelling a Hawaii hotel booking covers the hotel side in detail.

When the host cancels, or the listing disappears, you are owed a full refund on either platform, and both offer help finding a replacement. Airbnb’s rebooking policy and Vrbo’s VrboCare, which replaced the Book with Confidence Guarantee in October 2025, will find you a comparable place, but neither promises to pay the difference if the replacement costs more, and on a holiday week in Hawaii it will. A listing shut down by a county between booking and arrival is treated as a host cancellation, nothing more. Airbnb’s Major Disruptive Events policy, which overrides host cancellation terms, excludes foreseeable seasonal weather, so a hurricane in hurricane season does not by itself qualify, although a government evacuation order does, and the policy says nothing about enforcement. Our guide to an Airbnb or vacation rental host cancelling in Hawaii walks through the claim.

A hotel is not subject to the zoning enforcement that shuts a rental, so its legality risk is zero. Its risks are the ordinary ones, a strike, a disaster or a closure for renovation. Units sold as hotel rooms inside a condo rental program follow the zoning of the building, not the brand. That difference is why a verified legal listing is the price of entry for choosing a rental at all.

Who should book a vacation rental

A rental is the right call when four things are true at once. The stay is seven nights or longer, so the cleaning fee is spread thin. The group is four or more, or wants a kitchen badly enough to cook most meals. The building is inside a resort zone or Visitor Destination Area, or holds a registration or certificate you have checked with the county. And the owner is unlikely to exit before your dates, which on Maui means a hotel-zoned building or a trip before 2029. Families on Maui and Kauai for a week or two fit this best, and the Kaanapali, Wailea, Poipu and Princeville condo complexes are where the legal supply is. For a peak week, hold a refundable hotel rate as a backup until the rental is confirmed and verified. Our pages on family resorts in Maui and family hotels in Kauai cover the hotel side of that choice.

Who should book a hotel

A hotel is the right call for stays under a week, for couples and solo travelers, for first-time visitors who want a front desk and daily housekeeping, for anyone arriving on Oahu who wants to be somewhere other than the resort districts, and for anyone who cannot get a registration number or a building name out of a host. It is also the safer call for a 2028 or 2029 trip to West Maui, where the apartment-zoned condo supply will be shrinking toward the January 2029 deadline. Browse the registry by island: Oahu, Maui, Big Island and Kauai.

Vacation club resorts are the middle path most visitors miss

Between the two sits a category that gets the best of both. Vacation club resorts run by Marriott, Hilton Grand Vacations and Westin, and a minority of branded condo resorts, sit on hotel-zoned or resort-zoned land, so they are outside the Maui phase-out and legal wherever they stand. They have a front desk, a pool and usually a beach, and their units have kitchens and washers. They are booked like hotels, on hotel cancellation terms, through the same sites, and many charge no resort fee, though some add a daily amenity fee or a one-time cleaning fee, so read the listing. Many Aston, Outrigger and Castle managed condo buildings on Maui are apartment-zoned and are not in this category, so on Maui check the building, not the brand. The examples below are in resort zones or hotel districts.

How to verify a rental is legal in ten minutes

  1. On Oahu and the Big Island, ask the host for the registration or certificate number and the exact address. Every legal unit has one. A host who will not give both is your answer.
  2. On Maui, ask for the building name and check it against the county’s apartment-district list. A permit number applies only to short-term rental homes and bed and breakfast homes.
  3. On Kauai, check whether the parcel is inside a Visitor Destination Area. Outside it, ask for the nonconforming use certificate or homestay permit number and find it on the county list.
  4. Confirm the listing shows the host’s transient accommodations tax number, and check it in the state’s Hawaii Tax Online license search. A tax number alone does not make a rental legal, but a legal rental always has one.
  5. Pay only on the platform. Booking direct by wire or cash app removes every refund protection you have.
  6. Screenshot the listing, the numbers and the host’s answers. If a dispute follows, that is your evidence.

The full verification table with each county’s red flags is in our host cancellation guide.

Frequently asked questions

Is Airbnb legal in Hawaii?

Yes, in the places each county allows it. On Oahu that is the resort districts such as Waikiki, Ko Olina and Turtle Bay and a few mapped apartment pockets, for stays under 30 days. On Kauai it is the Visitor Destination Areas. On the Big Island it is resort, hotel and certain commercial and multifamily districts plus registered older rentals. On Maui it is hotel-zoned resort condos, permitted homes and, until 2029 and 2031, the apartment-zoned condos on the Minatoya list. Outside those areas a short stay is illegal for the operator.

Is Airbnb banned on Maui?

No. Maui’s Ordinance 5909 ends short-term rental use in apartment-zoned condos from 1 January 2029 in West Maui and 1 January 2031 elsewhere. Hotel-zoned resort condos and permitted rental homes continue. Bookings for 2026 and 2027 are unaffected, and there is no reason to wait until 2027 to book. The caution applies to 2028 and 2029 bookings in West Maui, where owners may exit before the deadline.

What are the Hawaii vacation rental rules for 2026?

Oahu allows stays under 30 days only in resort districts and mapped apartment pockets, with registration required. Maui allows them in resort condos, permitted homes and, until the phase-out dates, apartment-zoned condos. The Big Island allows them in resort, hotel and certain commercial and multifamily districts and requires county registration from 1 September 2026. Kauai allows them only inside the Visitor Destination Areas or under a grandfathered certificate.

Is a hotel or an Airbnb cheaper in Hawaii?

At the same nightly rate a hotel is cheaper for stays under a week and a rental is cheaper for stays over a week, because the rental’s cleaning fee is a one-time charge and the hotel’s resort fee is nightly. For a group that would need two hotel rooms a two-bedroom rental is cheaper at any length.

How many nights before an Airbnb is cheaper than a hotel in Hawaii?

About seven at equal nightly rates, and from the first night for a group that would otherwise need two hotel rooms.

Can I be fined for staying in an illegal Hawaii rental?

We found no county ordinance that fines guests. Fines of up to $10,000 a day on Oahu, up to $10,000 for unregistered operation on the Big Island and daily zoning fines fall on the owner or operator. Your risk is losing the booking, not a fine.

What happens if my rental is shut down before I arrive?

The platform treats it as a host cancellation. You get a full refund and help finding a replacement, but no guarantee that the replacement costs the same. Book a verified legal listing and hold a refundable hotel rate as a backup for peak weeks.

Are condo-hotels and timeshares affected by the Maui law?

Vacation club resorts in hotel districts are not. Condo rental programs and timeshare units inside apartment-zoned buildings, which exist along the Kahana corridor and in Kihei, are covered, so check the building against the county’s apartment-district list.

Do vacation rentals in Hawaii pay resort fees or hotel tax?

No resort fee, but the same 18.712 percent lodging tax on the rate and on cleaning fees. Some condo listings add their own nightly amenity fee, which is taxed the same way.

Is the Oahu 90-day rule in force?

No. A federal court blocked it in October 2022, so the minimum stay outside resort districts is 30 days. The city enforces that minimum and requires all legal short-term rentals to register.

Does Airbnb collect Hawaii taxes for hosts?

No. Hawaii requires hosts to register and remit the taxes themselves, which is why legitimate listings show the tax as a separate line and display the host’s registration number.

Which island is easiest for a legal vacation rental?

Maui and Kauai, where large resort condo complexes in Kaanapali, Wailea, Poipu and Princeville are legal and plentiful. Oahu is the hardest, since legal supply is confined to resort districts such as Waikiki, Ko Olina and Turtle Bay and a few apartment-zoned pockets.
